These terms and conditions govern and apply to anyone accessing or using our website. Please take some time to review these Terms for our services. By accessing or using the Services, including purchasing any products through the Services you represent, understand and agree to (1) accept, comply with and be bound by these Terms; (2) that you have the right to abide by these Terms; (3) to comply with and be bound by these Terms; (4) you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of France or another applicable jurisdiction.

Article 1 : The client

The client must be at least 18 years old and have the legal ability or have parental permission to make an order on this website. The client must be sure that his or her personal information in “My Account” are correct and complete. MILK society cannot be held responsible if an order cannot be made if the client’s information are incomplete or contain an error. MILK society reserves the right to cancel an order if there is any doubt on the good faith of a client.

Article 2 : Prices

The prices of the products are indicated in Euros and include all taxes except for shipping and processing costs/ Shipping costs are billed depending on the cost of the order. Shipping costs will be indicated before the order is completed by the client. MILK society reserves the right to change the prices at any time but the products will be billed according to the prices displayed when the order is made.

Article 3 : Les produits

L'acheteur prend connaissance des caractéristiques des produits vendus sur Bazar-bio. Ces caractéristiques sont données à titre indicatif et sont conformes aux informations fournies par les fournisseurs de Bazar-bio. Le client prend sous sa responsabilité le choix des produits grâce aux caractéristiques fournies par la page de présentation du produit.

Article 4 : Your order

When the first order is made, the buyer must create an account with his or her personal information. The customer must ensure the information is accurate and up to date. When completing an order, the customer confirms that he or she has read and accepted the General Sales conditions and accepts them without reservations or restrictions. After completing an order, the customer will receive an email confirming the summary of his or her order.

Article 5 : Availability

Our products are offered according to stock availability. Stock availability can be seen on the product page. If a product is out of stock, it will not be possible to order it. We can notify you by email when the product becomes available if requested.

Article 6 : Payment

Products must be paid for upon ordering. The costs of all orders are written in Euros with all taxes included and with the TVA rates applicable in France. MILK society has the right to cancel or postpone any order or delivery, in the case of non-payment of the entire sum due to the client, in case of error of payment or in case of legal dispute with the client. In order to fight internet fraud, your order information can be verified by third-party. Payment of orders can be made by Paypal or by a bank card. The following Bank Cards are accepted on the website: Debit Cards, Visas and Master Cards. The payment is encrypted and secured by Paybox. The client understands that the use of his or her bank card number on our Website will authorise removing funds from his or her bank account. The account of the customer will be charged on the day of his or her order.

Article 7 : Delivery

The products will be delivered to the address indicated by the Customer at the time of purchase. The Customer must ensure that the address indicated is correct and complete. Non-compliance to the procedures written here will mean that complaints by the Customer will not be considered. The order will be delivered to the address indicated on the bill. If there is no mailbox, or it is too small, the Customer will receive a delivery notice from the delivery service, which will allow him or her to retrieve the products ordered from the nearest post office within 15 days. After this time period, the package is returned to the sender.
No dispute can be made in relation to the delivery if the package appears to have been delivered according to the Post’s information system. If there appears to be an error or fault in the delivery (specifically damaged product, opened package, leaked product, etc…), the Customer must not open the package but most report the occurrence and bring the package to the Post office within 5 days and issue a complaint. Opening the package removes the responsibility of the Post Office in case of damaged or missing items. The buyer must inform MILK society of any such incidents within 48 hours of delivery to serviceclient@bazar-bio.fr and indicate the order number.

Delivery times once your order is confirmed are as follows:
Mondial Relay: 48 hours to 72 hours for France, Belgium, Spain and Luxembourg.
Colissimo: France 3-5 days.
Chronopost for France: next day delivery before 13:00.
Same day delivery between 15:00 and 18:00 for bicycle delivery in Nice.

Any order made before 11:00, from Monday to Friday (excluding vacation days) is generally processed the same day as long as products are in stock. Any order confirmed between Friday any time after 11:00 and Sunday will be processed the following Monday (Holidays excluded). Shipping costs are automatically calculated in the order summary and appear in the total balance to pay.

Article 8 : Return and cancellation policy

In accordance to article L. 121-120 of the consumer code, you have the right to a refund within 14 days of the receipt of your product without justifying your reason. The products returned to Bazar-Bio must be in perfect resale condition, in their original state (packaging, accessories, information sheets…), sealed, and sent with their order number. Any risk associated with the return of the product is the Customer’s responsibility. Bazar-Bio will exchange or refund any product (excluding shipping costs) within 30 days. To return a product, you must first send us an email to serviceclient@bazar-bio.fr to obtain a approval. Please specify your order number and let us know which product you are returning. Once you receive the approval please send the products to the following address:

Article 9 : Responsibility

MILK society cannot be held responsible for non-delivery or breach of contract if a product is out of stock, in case of force majeure, in case of disturbances or partial or total strike in the postal services or transport and/or communication services.
MILK society, as an intermediary sales agency, cannot be held responsible for damaged products. The responsibility lies entirely with the producer, in accordance with article 1641 of the civil code. MILK Society is neither responsible for the quality of products sold on the website, nor any unwanted side effects they may provoke.
The producers are entirely responsible for the quality of the products and any unwanted side effects. The photography and texts produced illustrating the products are not contracted. As a consequence, MILK is not responsible in case of error in the photography or text.

Article 10 : Protection of personnel information

MILK society will not expose any personal information you provide. This information will remain confidential – your privacy is important to us. Your personal information will only be used by our service team to process your order and to communicate with you. MILK society reserves the right to place cookies in your computer when you visit the Website. The cookie will not identify you but will only signal previous visits to the Website in order to help us to personalize the service. In consequence and compliance to the computer information law and liberties act of January 6, 1978, you have the right to access, to rectify and to remove any personal information that concerns you. Article 11 : Applicable rights and competence juridiction

This contract is written in English and complies with French Law. In case of legal litigation, only French tribunals will have jurisdiction.

Article 12 : Intellectual property

All the elements of this website (images, text, video, comments, logos, and charts) are the intellectual property exclusive to MILK society. Any other use will be considered as infringement and will be sanctioned against the Intellectual Property laws unless previously agreed upon on our behalf. All rights reserved.
